information it obtains through the Zipmark Service.
The “Zipmark Service” is defined as any website, mobile application, or Internet service under the control of Zipmark, whether partial or otherwise, in connection with providing a platform for Zipmark’s services.
Personal Information Defined. Zipmark considers “Personal Information” to include information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number. Zipmark does not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.
The Zipmark Service Collects Your Information
Personal Information Collection. To use the Zipmark Service, you must create an account by providing some Personal Information, such as name, address, driver’s license number or last four digits of your social security number, bank account number, bank routing number, username, and password. We also collect the information you provide while using the Zipmark Service, such as transaction information.
We may collect Personal Information about you or from you when you or another user creates an invoice. The invoice may contain your name, and details of purchased items or services. The user that creates the invoice may also provide your email address or telephone number, so that Zipmark can send you an email or text message to invite you to join the Zipmark Service and make a payment.
Third Parties. To protect you from fraud or other misconduct, we may obtain information about you from third parties to verify the information you provide. For example, we may use fraud screening services to verify that your provided information matches the bank account information on file with the bank.
Social Networks. You may import contacts from social networking websites (“SNS”), such as Facebook and Twitter, to make requesting payments from your contacts easier. When you import contacts, the Zipmark Service may collect the information you and your friends have made public in those SNS’s. The information the Zipmark Service can access may depend on your privacy settings in the SNS. For example, when you import from Facebook, we collect Personal Information about you and your friends, such as your friends’ names, and add them to your contact list in the Zipmark Service.
Customer Support. We may collect Personal Information through your communications with our customer-support team.
Mobile Device. We may collect and store your location information if you enable your computer or mobile device to send it to us. Changing the settings on your computer or mobile device may prevent this data collection.
“Cookies” are bits of information that are stored by your browser or app on your computer or mobile device. This technology allows for the storage of user preferences, user ID, and password. You can turn off the “cookie” function in most standard Internet browsers; however, the majority of the features of the Zipmark Service may not function properly without them.
The Zipmark Service automatically collects other system information, such as your web request, Internet Protocol (“IP”) address, browser type, browser language, domain names, referring and exit pages and URLs, platform type, number of clicks, landing pages, pages viewed and the order of these page views, the amount of time spent on particular pages, the date and time of your request, and the unique identity of your browser. This information is used to analyze trends, administer the Zipmark Service, improve the design of the Zipmark Service, track user movement, and otherwise enhance the Zipmark Service.
When using the Zipmark Service from your mobile phone, we may collect information about your phone, including device and hardware IDs, for technical support and services.
By using the Zipmark Service, you are authorizing Zipmark to gather, parse, and retain data related to the provision of the Zipmark Service.
How Zipmark Uses Your Information
Internal and Service-related Usage. Zipmark uses Personal Information for internal and service-related purposes only and may provide it to third parties to allow Zipmark to offer the Zipmark Service. For example, the Zipmark Service will use your bank account numbers to make a payment. Your Personal Information will only be shown to other Zipmark users with which you have a payment request or made a payment in the past. Your payment history is viewable only by you.
Direct Marketing. Zipmark does not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for direct marketing purposes. Zipmark may allow access to other data collected by the Zipmark Service to enable the delivery of direct marketing and offers that will be of greatest utility, relevance, value, and interest to you.
Improve Service. We may retain any data you provide to:
Aggregate Data. Zipmark may anonymize and aggregate data collected through the Zipmark Service and use it for any purpose.
ZIPMARK May Disclose Your Information
Vendors and Suppliers. Zipmark may share any information it receives with vendors and service providers retained in connection with the provision of the Zipmark Service. For example, your bank account numbers will be shared with banks and other entities in the financial system that process transactions. In addition, to protect you from fraud or other misconduct, we may provide your Personal Information to third parties to help us verify your identity and bank account status.
Social Networks. When you import your contact list from a social networking website (“SNS”), we do not disclose any of the information Zipmark has collected about you with that SNS. For example, the Zipmark Service will not share your bank account numbers with Facebook.
When you want to request a payment from a non-user that you imported from an SNS, the Zipmark Service will attempt to contact that person through the SNS. In other words, if you imported your Twitter friends, we will attempt to send a direct message to your friend using Twitter. We will not share any information with the SNS that the SNS has not already collected about you, other than the contents of the message inviting the non-user to join and make a payment using the Zipmark Service.
As Required By Law and Similar Disclosures Zipmark may access, preserve, and disclose your Personal Information, other account information, and content if it believes doing so is required by law or if those actions are reasonably necessary to:
Zipmark System and Related Security. We may disclose information about you, including information regarding your use of the Zipmark Service, to third parties if, in our sole discretion, disclosure is necessary to protect our systems, website, business, users, or others.
Zipmark may also disclose your Personal Information with your permission.
Security of Your Information
By using the Zipmark Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Zipmark Service. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Zipmark Service or sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us at firstname.lastname@example.org.
Zipmark does not knowingly collect, maintain, or use any Personal Information from children under 13 years of age. No part of the Zipmark Service is directed to persons under the age of 13. In fact, you must be at least 13 years of age to set up an account with the Zipmark Service. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS the Zipmark Service AT ANY TIME OR IN ANY MANNER.
If Zipmark becomes aware that it has collected any Personal Information from children under 13, it will promptly delete such information from our databases. If you are a parent or guardian and discover that your child under the age of 13 has obtained a Zipmark Service account, then you may alert Zipmark at email@example.com and request that Zipmark delete that child’s Personal Information from our systems.
If you are accessing the Zipmark Service from any physical location with regulations or laws governing personal data collection, use, or disclosure that differ from United States regulations or laws, please note that through your continued use of the Zipmark Service, you are transferring Personal Information to the United States of America or other jurisdiction where such information may be processed and you consent to that transfer.
UPDATE YOUR INFORMATION OR POSE A QUESTION OR SUGGESTION
Zipmark reserves the right to send you certain communications relating to Zipmark, such as service announcements and administrative messages that are considered part of your Zipmark account.
